USTR published in a July 1 Federal Register two notices that provide market access for Canadian sugar and sugar-containing products in line with the U.S.-Mexico-Canada Agreement.
- Additional Refined Sugar: Under USMCA, Canada is entitled to 20 percent of any increase in the U.S. refined sugar quota (except for increases for specialty sugar). Since the U.S. increased the refined TRQ on April 3, Canada is entitled to fill, on a first-come-first-served basis, 36,287 metric tons, raw value, of the increase. The additional sugar access for Canada under the USMCA is a calendar-year quota that could enter July 1 through December 31. This amount is in addition to Canada’s share of the WTO refined sugar quota.
- Sugar-Containing Products: USTR announced that Canada has determined to administer its additional SCP access through the use of export certificates, which will be issued by the Canadian government. U.S. Customs and Border Protection will require SCP imports from Canada to be accompanied by an export certificate.
